Question about partial ownership of an interest in a home?

cbs1549 asked:

In a will, I, my brother, and my sister were left interests in the family home. The language contained was to share and share alike. We are all still living. My brother insists on living in the home however the home is in shambles and my sister and I would like to sell our interest in the home. Can we do this?
Could we give him the option of purchasing our interests in the home?
If he refuses, do we have a right to force an appraisal/sale of the home?
Any help is much appreciated.

The three of you are separate legal entities. You can force a sale. In the meantime, your brother should be paying the both of you rent.

  2. Home Sales

You and your siblings own the home as tenants in common. You have a right to sell your undivided interests in the property to a stranger, but that sale would be at a discount because nobody wants to own an undivided half interest in a property with a stranger.

You can petition the court for partition of the property. The court can order the property sold and have each of you paid for your fractional interest.
